There are two lines of thought. One is that Rumple created the fail safe but lied to Regina about what it would do. In this line of thought, the fail safe actually takes everyone back to the EF without killing them. The other line of thought is that Regina is responsible for the fail safe and wrote it into the Curse at the same time she changed it for the “please” clause with Rumple. If that’s true then it probably does kill everyone.
