Who would win in these Court cases?

    Cinderella vs Rumplestiltskin

    Case: Who gets the baby?

Cinderella: I don’t want to give my baby up!
Rumple: You signed a contract, I upheld my side of the deal, now pay up!

    Regina vs Snow White

    Case: She started it!

Snow: Regina has tried to repeatedly kill me
Regina: You told my mother about Daniel, therefore you are responsible for his death. I want revenge!

    Regina vs Belle

    Case: Solitary Confinement and Lacey

Belle: Regina kept me separated from my true love for over 28 years! She gave me an alternate personality to keep us apart!
    Regina: Rumplestiltskin had it coming!
Rumple: And you wonder why I set a wraith on you?

    Snow White vs Rumplestiltskin

    Case: Ownership of the necklace

Snow: Rumplestiltskin took my mother’s necklace from me!
Rumple: Snow and her prince constantly pester me for help and waste my time. I deserve something for my trouble!

    Maurice vs Rumplestiltskin

    Case: Belle

Maurice: Rumplestiltskin took my daughter away from me!
Rumple: I don’t see her complaining, do you?

    Gepetto vs Jiminy Cricket

    Case: Puppet Parents part 1

Gepetto: Jiminy turned my parents into puppets!
Jiminy: It was an accident! I said I was sorry!

    Jiminy Cricket vs Rumplestiltskin

    Case: Puppet Parents part 2

Jiminy: Rumplestiltskin gave me the potion that turned Geppetto’s parents into puppets!
Rumple: I didn’t force you to use it!

    Rumplestiltskin vs Blue Fairy

Case: Baelfire and the Portal Part 1

Rumple: You took my son away from me!
Blue Fairy: I was helping him escape from you!

    Rumplestiltskin vs Tamara

Case: Baelfire and the Portal Part 2

Rumple: Tamara shot my son and sent him down a portal to another land!
    Tamara is unavailable for comment.

    Baelfire vs Rumplestiltskin

    Case: The Price of Magic

Baelfire: My father was once a good man but changed for the worst when he became the dark one!
Rumple: I needed magic to protect my son!

    Tinkerbell vs Blue Fairy

    Case: Lost wings

Tinkerbell: Blue Fairy took away my wings after I tried to help someone!
Blue Fairy: You broke many fairy rules!

    The Enchanted Forest vs Regina

    Case: The dark curse

Enchanted Forest: Regina cursed us to live in a small town in Maine called Storybrooke.
Regina: It’s Snow White’s fault, she drove me to it!

    Two cases convicted:

    Cinderella vs Rumple

Its not legal too sell your unborn babies. Its not legal to buy unborn babies- Both parties guilty!

    Regina vs Snow

If the case is as you say- WHO started it? WHO got the ball of wrongdoings rolling?.

Then Snow did. She did the first wrong, which was tell even though she had promised not too. But I dont think this would be a case anywhere other then on the kindergarten playgroud. Where I would say too the kids “Your both guilty of being kids, grow up allready!”

(fun thread by the way 🙂 )

Hmmm, a lot to think about here. I need to take a recess and then come back later and share my deliberations.

It’s hard to see the whole list with all the pictures!  I’ll do a few of them.

Assuming an english common law based system like in the US, and a judge with magic enough to enforce judgements and know everything we know as audience, and prove it:

    1) Cinderella Wins against Rumple.

Agree with MedChen, though technically in the US you can make contracts for someone to pay expenses of a birth, then adopt the child, but you have the right to change your mind post birth.  Straight up selling though is not legal.  Contracts that are “unconscionable” are void (so some states something that is a criminal act, like ordering a hit, drugs or  prostitution is illegal even if both parties consent and make a deal, you couldn’t enforce the contract in a court of law).

    2) Regina vs Snow.    Regina is in the wrong for 99%, except for the candle incident.  Snow is guilty there, but it would be a lesser degree of self-defense arguably (as logically as you can assess crazy magic situations).

Snow was only 14 when she told a secret, which a reasonable person of her age and circumstances would not realize would result in any harm, let alone the result, Daniel dying by Cora’s hand.  Cora is responsible for killing Daniel, not Snow. Regina is only  justified in not wanting to be friends with Snow for telling a secret.

After that it was a matter of Regina usurping the throne by murdering Snow’s father, so she was not legitimately the Queen, and Snow fought a batttle to reclaim authority.  It appeared the people supported her, so Regina was rightfully deposed.

It doesn’t matter who “starts” animosity, but in a sense of justice, it matters how each party chooses to escalate it.  If someone trips you, as Eva did Cora, it really doesn’t justify hunting them down and poisoning them years later, and then seeking to ruin the next generation’s life too.

3)Regina V Belle:  Belle wins, Regina kidnapped her and imprisoned her presumably without cause, see above, Regina not rightful ruler anyway.  IN SB, Regina caused Belle to have false memories, so I suppose that’s similar to causing someone brain damage or a psychotic break with drugs.  Some kind of assault anyway.  Belle wins.

    4)Rumpel vs Snow.

Rumpel took the necklace, as price for summoning him.  If Snow knew the rules of contacting Rumpel were that he could claim virtually any fee he wanted, then as long as the fee was not an unconscionable sort of deal (firstborn, murder something a crime basically), well, fair enough.  All House Rumpel Calls come with a price and it was a necklace.  That I hope we see again!  In some cases states will step in to obviously unfair bargains made under duress (which is why we have usury laws, that govern rates lenders can charge) but I’m not sure this was quite that.   Again hard to judge with the crazy situation of magic, how much should it be worth?

    5) Maurice vs Rumpel

Belle freely made the deal and is an adult of age to bargain for herself.  Maurice has no real cause, except Belle might in the sense that her contract with Rumple might violate modern concepts of fair labor (seriously, did she have any days off, rights to care –Rumpel probably did treat her well eventually though!  Better deal than the dwarves get in the mines I think, but hey it was a feudal society!).

    6) Gepetto vs Jimminy

Jimminy didn’t intend to kill Gepetto’s parents, but he did intend some kind of harm to his own.  Generally if you intend to harm someone but cause foreseeable harm to another you are still responsible for that harm to the unintended target (example, shooting a gun to kill one person, you hit an innocent bystander instead). Or say, making a poisoned apple turn over….so it is a bit debatable here since Jiminy’s parents suspected the danger and chose to give it to Gepetto’s family, but I think I’d still side with Gepetto. Jimminy messed with magic mojo, and brought harm to a poor little boy.

“If I had a world of my own, everything would be nonsense. Nothing would be what it is, because everything would be what it isn't. And contrary wise, what is, it wouldn't be. And what it wouldn't be, it would. You see?” -- Lewis Carroll, Alice's Adventures in Wonderland & Through the Looking-Glass

Root of all guilt Rumple’s dad! All others are only guilty of being trapped in a Fairy Tale Catch 22. My advice to them pipe down and learn to live together, if they can’t then they’ll punish themselves far better than anyone else could.

Good points, @kfchimera What about Tink and the Blue Fairy?

There is line from the first PotC movie that I think fits Tink’s situation:

the rare occasion that the right course demands an act of piracy; piracy itself can be the right course

Did she break the law? Yes but was it the right thing to do: to give hope to someone who had almost lost all hope? I think so. Blue is cold and rigid (and SNEAKY) and apparently doesn’t think people can be saved or at least should TRY to be saved.

In a court of law, Tink would probably be found guilty. But outside of the law…I think Tink did the right thing.

I agree. I don’t like how Blue decides who the fairies can and cannot help. I thought the fairies helped everybody who needed it.

And here ladies and gentlemen, The enchanted Forest presents further court cases for your consideration.

We bring before you the Nameless Seer Vs Rumplestiltskin

Seer: Your actions on the battlefield will cause you to lose your son. Rumple: I would not have come the Dark oen if not for this prophesy. Seer: A Young boy will lead you to him, that boy will be yoru undoing.

Rumple: I only act in self preservation.

Next Case: The Enchanted Forest recognises Killian Jones vs his Majesty the nameless king

Killian: I had ot become a pirate because your mission was unjust.

King: So because you get one  unjust mission you decide to forsake morality altogether.

    Case: Hook vs Rumplestiltskin

    Hook; Milah was willing.

Rumple; Milah was Baelfire’s mother. seh should have stayed.

Witness MIlah is unavilable for comment at this time.

What do you think of my additions?
