How did Regina lose custody of Henry? I have watched those episodes to try to gain understanding but it seems as if, once Emma returned from FTL, it was just assumed that Henry would live with Emma instead of Regina. Did the breaking of the curse nullify the adoption? Or was there not an official adoption? Did Regina just “obtain” Henry from Rumple (with help I am sure) and not do it legally?
Remember in Broken when David took custody of Henry after Henry said that he didn’t want to stay with Regina anymore? Then in We are Both Regina gave up custody to David again after she used magic to get him back. After that Regina went on this mission to redeem herself but David still had custody now when Emma’s back she just took over but there was nothing more formal than that. We haven’t seen Henry’s initial adoption so who knows how formal that was to start with.
