I don’t know how to feel about this theory that occurred to me last night but it would explain some things as an in-show reason rather than it simply being a case of “The part was recast and the tattoo/OQ storyline hadn’t been thought of at that point”.
My crack theory is that the “Robin” we saw in Lacey wasn’t actually Robin Hood and that Marian was actually cheating on Robin with the thief from Lacey.
Evidence:
1. The thief in Lacey is never actually called Robin by any of the characters that interact with him nor does he call himself Robin Hood. The Sheriff was the only one who referred to Robin Hood and he didn’t actually see the thief that RumBelle were chasing so he assumed that Robin was the one they were after.
2. The “Robin” in Lacey doesn’t have a tattoo whereas Robin does and, as shown in flashback, had one before the events of Lacey.
3. Roland has dark hair compared to Robin’s light hair so might not be Robin’s biological son.
4.Robin stole Marian from the sheriff and the thief may have stole Marian from Robin. Afterall, if someone is prepared to cheat on their partner with you, what’s to say they’re not prepared to cheat on you with someone else?
5.Magic is supposed to have a price. Marian was doing a-okay until Regina came along in the EF, which didn’t seem like a consequence of magic, so maybe the thief paid the price with his life.
6.This show isn’t adverse to showing adultery amongst married couples.
7.It actually makes OQ more likeable since Regina wouldn’t be stealing Robin from a loyal devoted wife.
8.It makes Robin look better if he does end up choosing to leave Marian for Regina. It also gives him bonus points for taking Marian back in the past (if he knew about the affair) and also for raising Roland as his own.
9. It could also explain Robin blaming himself for losing Marian. He wasn’t talking about Marian dying, he was blaming himself for Marian having an affair because he wasn’t a good husband in his view.
10. It could also explain what Tinkerbell meant when she said that Regina not meeting Robin ruined his life. Robin ended up married to an unfaithful wife.
11. The thief’s attitude to magic in Lacey seemed different to Robin’s attitude to magic especially in the OUATIW flashback.
Possible contradictions to the theory:
1. Robin knew about the fire spell on the door
However, the thief in Lacey came through the window not the door plus Robin was living in the dark castle at the beginning of season 3 so he may have already discovered some of the dark castle’s nasty surprises.
2. Robin said Rumple saved his life.
However, it was actually Belle that saved the thief’s life. What if Rumple and Robin have met each other in the past but it was not the events of Lacey and thus Rumple did save Robin’s life?
3. Robin and Belle know each other
However, there is a window of time where Belle and Robin could’ve met that doesn’t involve the events of Lacey. When Rumple lets Belle go the first time, before she meets Regina, she’s walking through a forest and Robin obviously lived in a forest. Also when Rumple kicks Belle out, before her yaoguai adventure and capture by Regina, she’s at the tavern. She could’ve met Robin and helped him before she met Dreamy.

Adam made this clear the night the WL episode aired: Robin’s attitude toward magic in WL was before he ever met Marian. Adam says it changed because someone he loved was in danger (ie: he had to go and steal the wand to make Marian better)

Mostly I think you already know the answer to this:

Also remember, Adam and Eddy write season to season. They could have had an idea how to make Robin into a bigger role later on.
All the writers on Once attend a writers camp before the season starts, to get ideas and work those ideas into the story.

However I don’t want to make Maid Marion to be cast in even more negative light then she already will be seen. No need to sully Maid Marion any further, and the last thing I want to hear see she deserved to die because she was having affair. In light of the other crimes that other characters committed, affair is not worthy of death. Some one said that perhaps Maid Marion is really in love with little John a while back. So that both Robin and Maid Marion are willing to part ways amicable. That’s not a bad idea either. But I have this idea that Maid Marion will probably just die as way of time fixing itself. As the Doctorrefers to it, A fix point.
I thought a better idea then replacing actors for same character would have been just make this Robin Hood the son of Robin or brother of Robin. Roland can be his nephew that he is taking care of in honor of his brother. That way Robin Hood and Maid Marion would be intact. Also we could avoid another pointless love triangle where everyone who is basically everyone knows its going to end in Outlaw Queen favor.
