First off, yes, definitely just a friendly disagreement! Especially because I really don’t think any of the characters see it as an issue anymore since Henry really is old enough to determine what he wants, within reason, and they all want what’s best for him. I actually quite like looking at it this way hypothetically: what would happen if they really were going to abide strictly by our legal system and nothing else?
And yes, I do think that Regina created a paper trail for Emma and Henry at the end of 3A, because we know they had a normal life in NYC for a year. He had to have had records for that, and they couldn’t have been from Storybrooke because for that year, it didn’t exist (whether it exists to the outside world before and after that year is debatable). So, paper trail and records of Emma being Henry’s mother, as well as witnesses from outside Storybrooke of Emma and Henry being a family that has always been together. And in the face of that, if there were any other documents indicating that Emma had signed her rights away, it would certainly look like those were the false documents since they wouldn’t be supported by any evidence while the others would. Like PoM said above, Regina had to give up the thing she loved most; she gave Henry up and had been resigned to never seeing him again and the two of them integrated seamlessly into a normal life in NYC.
And for what we’ll actually see in the show…I don’t see why he couldn’t switch off weeks; that seems to be the simplest solution. Then they could go from there, maybe changing things up depending on what else was happening. That way they’d both have equal time with him. And they could all come together for holidays or something. 🙂

Regina, although few Oncers find her adoption to still be illegal, has those rights because just as there are documents for Emma’s non parental rights, somewhere in Boston, the Agency has documents of Regina adopting Henry. So….by law….Henry is Regina’s son.
So let’s see if I understand this. Regina, the Evil Queen of another land that is not accessible by normal methods, casts a Dark Curse that creates a town out of thin air and apparently gives everyone “legal” and “real” identification that you would find for any other citizen in America; uses Mr. Gold’s ability to cut through Red Tape and work the system to get herself a child, all under the radar, and that’s all 100% legal and fine. But when Regina casts the counter curse and grants Emma and Henry memories of the same so called real life, complete with apparently enough money to buy an apartment in New York City, and provides documentation including birth certificate, SS#, doctor records of vaccines, ect–all of which is required for Emma to buy an apartment or have a job or Henry to go to school–that’s not legal and binding and real? And then Snow and Charming casts some version of the Dark Curse–which is not the same as the original given that everyone remembers who they are and are not separated from their loved ones–and restore SB at least in looks, suddenly the legality of Emma’s rights are washed asunder? Even though the real world was not touched by Snow and Charming’s counter-counter-whaever-the-heck curse, thus why SB could exist simultaneously while Emma and Henry were living in New York–with job, apartment, and schooling? At this stage in the game, in other words, both Regina and Emma have the same legal rights to Henry, both of which were created by magic and not through any sort of American recognizable legal channels.
In a sense…all of that…yes RG! It’s just like magic! 😛

I. And there is no proof that SB isn’t recognized by our government.
Actually there is. When Owen brought the state police back to the town line in “Welcome to Storybrooke”, one of the officers said “There’s no town called Storybrooke anywhere in Maine” And of course none of them, even Owen, could see the town or Regina standing just across the line. So they’ve established that Storybrooke does not exist in any official records. This also implies that faking background reports must have been part of the service Rumple provided in Henry’s adoption since a real background investigation would have failed to find any town called “Storybrooke.”
Of course, we know the Curse provided some sort of an interface between Storybrooke and the outside world because we saw that they had phone and internet connections to the outside world before the curse broke. I’ve always wondered where they get their electricity from. Is there a Storybrooke Nuclear plant?
