    What to make of this tweet?
    If their pictures are embedded using Spoiler TV’s provided embed code, then its okay? ❓

    The “fair use” issue is something I’ve considered and think could still be valid. However, there’s a slight difference with his photos. “Fair use” covers use of copyrighted material for the sake of commentary or review. We do this with screenshots in our shownotes, sound clips in our podcast, and music clips in our soundtrack review. In each of these, we are directly commenting on the copyrighted work itself—they’ll all official parts of OUAT and we’re commenting on OUAT.

    But these photos could be a slightly different issue. They’re not officially OUAT, and we’re commenting on the OUAT inside the photos, but not the photos themselves.

    Then again, I could be too technical on this.

    The point is that the copyright holder is clearly not happy with how his images are moving around on the Internet and he’s already sending DMCA takedown notices to sites he deems as infringing on his copyrights.

    To the responsibility point, I’m not responsible for the opinions posted on this site. But if someone uploads a photo to the forums, it is hosted on my server and thus redistributes someone else’s work.

    SpoilerTV and Vancity Filming have a special agreement and SpoilerTV provides embed codes for these photos. But those embed codes won’t work in these forums because we block HTML and Javascript.

    By the way, Vancity Filming has offered a “blanket permission” for using their photos, but it’s much more than we can afford.

    They’re trying to charge other sites for the permission to use their photos? All I can say is, wow….

    I don’t understand the posters not understanding the copyright holder doesn’t want photos (his intellectual property) being posted elsewhere. He owns the copyright. That would be like me taking copies of a book and posted them online. Not cool. Posting a link is easy and doesn’t put the site owner at right. Easy peasy.

    Valid points, although I’ve heard that ABC themselves are not enthused with Vancity or those other photo sites taking photography during filming of episodes either. Most likely, ABC’s issue is that these photos tend to spoil certain things to the public way ahead of time. Of course ABC’s own publicity department spoiling things is another issue in itself =p. I think since those photos were taken on public streets, since Stevestone is a real town, it is technically fair use. Of course that doesn’t mean ABC still wouldn’t be peeved about it, and I wouldn’t be surprised if they have at least attempted a claim to have those sites remove all photos before just like Vancity is telling the rest of the internet. They might be his photos and property, but they are still photos taken of ABC’s property.

    I woke up this morning to check my tumblr and saw a post that apparently, VancityFilming’s twitter account has been bashing our lovely OUAT actors.

    I’m not saying that’s okay to go ahead and re-post photos but that’s a very jerk thing and unprofessional thing to do.

    Don’t worry. They’re big boys and girls. Vancity Filming is there on the scene and can see stuff we can’t. Maybe there’s a good reason for it. Let it go, though. The sun will rise again tomorrow.
