Emma was right for not taking the keys when she saw them in her office. She said herself everytime I went against her she saw it coming. If she took them and then the keys were gone; she was caught in Regina’s office once. Someone like Regina can put two and two together and come up with Emma. They both have a feud going and whether of not she did it she will get blamed, thus Regina = win this time and Emma = loss this time.
At this point i think Emma should just steal the keys though. Especially once she believes.

Good point but at the time when she first found the keys, she never would have guessed that one of them would be planted in MM’s cell and another would open their apartment.
If you are refering to now then the answer is yes.
I am referring to now. Especially now that Mary is no longer in danger of going to jail because Kathryn has been found alive. Emma should take the keys just so that Regina can’t use them against them again and so that she can use them if she needs to.
No, even now no. they should let the events play out in court and blam!! Kathryn shows up in court. I’d like to see the look on Regina’s face and the look on DA Albert Spencer’s face and even Mr. Gold’s face (if he does have not a clue to Kath). After that perhaps everyone in town will start to either be on Emma’ side, leave MM alone and Operation Cobra can continue.
