That is an interesting theory, but I’d interpreted their comments in the podcast sort of differently. The question they were asked is if George would be formally arrested for murder. They said that SB isn’t exactly open to outsiders, (and I admit, their use of that particular word does seem to link to Barrett), and if he was convicted of murder he’d have to go to a state penetentiary, and the charges would be for the murder of a mouse and a frame job on a wolf. They did say that we’ll see what happens to George, but I got the impression it’d be some sort of special, SB justice, as opposed to a proper, real world trial, which would involve a whole lot of extra cover up stuff to make it look real, and frankly, I doubt any SBers would think he was worth the effort of setting up all that cloak and dagger stuff. Given that SB operated in and of itself for 28 years, largely shut off from the outside world, I don’t necessarily think that George was registered with any real world, official, legal organisation in order for him to be SB’s DA. Just like the SB school system didn’t have to answer to any state regulations, and Dr Whale wasn’t officially registered on any medial board anywhere. I’m thinking that George’s punishment will be something slightly more medieval, as opposed to a real world trial and a jail sentence.

I get what you’re saying about SB being closed off to the real world. Yet, even before Emma broke the curse, we saw that the judicial system of SB was certainly linked to the greater state of Maine; when Mary Margaret was thought guilty of Kathryn’s murder, MM was going to be sent across the town boarder to an outside penitentiary. That means the small court system in SB feeds into a much larger state judicial system, and it follows that as the DA, Decker/George must’ve been a state official (even though it was the curse who made him a lawyer in the first place).
As the town sheriff, Emma also won’t allow George’s trial to become just a medieval show of “justice.” Emma grew up in our world, and when Dr. Whale tried to form a mob to murder Regina, Emma stood firm and said she’s still the sheriff and that’s not how we handle things in this land. So I believe she will execute the law with due process, assume George is innocent until proven guilty (even though she suspects otherwise), and he’ll be given a fair hearing with a jury of his peers. Also, since Regina’s no longer the mayor of a cursed town, she won’t be able to pull the strings to get George out of trouble.
Also, while SB may not have been on any state map, that doesn’t mean no outsiders could enter it. Emma’s and August’s arrival in town last season show that outsiders could in fact enter and leave. They just needed to know where to look. Also, whoever brought baby Henry to SB ten years before Emma’s arrival, was able to come and go. (I think August did since when Emma questioned if he’d ever been there before, he didn’t give a straight answer). Barrett, though “an outsider’, could have a knowledge of SB, because though unrecognized as being from FTL, he could be from another far-off land and have heard about the dark curse bringing people of the EF to a without magic. Perhaps he came to our world to seek out SB, thereby knowing where to look.

😆 Yeah, and Snow White’s apartment is more like a studio loft, with an open bedroom downstairs. No walls mean Emma and Henry wouldn’t even be able to go downstairs to make breakfast without seeing Mom and Dad/Gram and Gramps naked in full view. 😳

Was she really actually gonna be sent to a non-SB jail though? The whole plan was originally set up so MM would run over the town border, “And, once she tries to leave Storybrooke, well… We all know what happens to people who attempt to leave town.” I always figured that any talk about her being sent away anywhere was just talk, because Rumple and Regina had to make it all seem legit, especially for Emma’s benefit. If MM had actually been taken near the city limits, something bad would have happened to her, and she never would have made it to an outside jail, so there was no need for any involvement from anyone outside of SB in that whole process at all.

That was before Emma had experienced FTL, and fully accepted that she, and all the SBers, were part of this FTL way of life though. Also, it looks like she’s headed out of town again pretty much instantly, so any punishment dished out to George might well happen when Charming is running the town. We already know that Charming had the chance to take George out in FTL, so this will be his second chance, and I wonder if they could show Charming being tempted to kill him this time around if there was a real world presence surrounding his prosecution.
