So, in the episode Hat Trick, Emma makes a new hat for Jefferson. It was implied, if not confirmed, that it was magical, due to the whole Mary Margaret ninja thing. Though George burned the “original” hat, couldn’t the new found dust work on the “new” hat?

I have a question… if two go thru the hat… do they need the WRAITH to also go through with them in order to get back to SB. How do they get the hat back to EF/ FTL in order to use it?
I do not think that HOOK is out of the picture yet… I think fairy dust that Grumpy and the dwarfs dug up will fly the ship back. I think the ship can fly to wherever they want to fly to … so they can get back…. UNLESS HOOK is very ticked at Emma and leave her and SNOW behind.
Do you think they will take MULAN and Aurora back with them to SB…. they might be alllllll alone if they leave them behind.

A spoiler for an upcoming episode talks about Gold & Reggie preparing to kill anyone who comes through the portal. So, it could very well be that Emma & Snow make it back through the hat and that Cora managed to get the compass from them and has her own portal.
Good question Nonnie about whether they need to come back with the wraith. That is certainly not something that the writers would miss.

Is he invested enough to bother telling anyone that it might be lying around somewhere and they might wanna try it? I guess if Emma thinks of it, she could mention it to Aurora, who could mention it to Henry, who could mention it to Charming.
I never thought that hat worked when it and Jefferson fell out the window, but considering Emma made it, I wouldn’t be surprised if it could be activated using fairy dust.

I am not sure but I think you might be wrong here. When Jefferson and the hat took a spill out his 2nd story window he had “disappeared” by the time the girls (Emma and Snow) made it to the window to look out. I think the hat already works. He fell out the window and into the hat. That’s how he vanished so quickly.
I don’t really have an explanation for him being back in SB now though, if he did go through the hat, he had to have come back out of it. Of course we don’t know what Emma did with the hat and we didn’t see Jefferson in the time between when he fell out the window and when Charming found him in the overturned car.

Well, one of the doors in the hat is a Wonkavator, so, by extension, there is Wonkavision. 😉

The thing that gets me though is that when we’ve seen Jefferson’s hat work, there have been certain conditions. It has to sit flat, then it starts spinning, and takes a few moments to whip up a huge, swirly, tornado type environment before you jump in. There was none of that when Jefferson and the hat fell out the window. There was a very faint whooshing sound effect, just enough to make you wonder if something happened, but there was no sign of even a stiff breeze outside, let alone the standard portal tornado, when the hat just toppled out the window, not spinning in any uniform way. It simply doesn’t match up to how we’ve seen a hat portal work previously, so I’ve never bought into the theory that it worked.
I think that Emma could have made a working hat, if she’d been open to the possibility of it, but she was in full on denial mode with her guard up at that point in time, which prevented any magic from flowing through her. The times we saw her actually have an effect was when she let her guard down and actually let herself feel and believe in that emotion. That’s why her kiss made Graham remember, because she felt a legit emotional connection to him, and let her guard down and allowed herself to feel it. And it’s why, when she was in that emotionally open state at the hospital that she touched the book and remembered. How many times had she touched the book before and had no reaction to it? She could only make the magic flow if she wasn’t actively trying to prevent stuff from getting through her walls. And she was all about having her walls up when the crackpot who thought he was the Mad Hatter was forcing her to make a hat at gunpoint. Much like touching the book at that point in time didn’t trigger anything, I don’t think her touching that hat triggered anything either.
There was an open window right near where Jefferson fell down, and I think he just scrambled in there in the couple of seconds it took between him falling and the girls looking out the window.
Also, I think that if he had gone somewhere through the hat, he’d have mentioned to Charming that there was another working hat when they had the conversation about his broken one. He could have mentioned it to Regina when she wanted to get the apple, instead of going to all the trouble of trying to make his old hat work just enough to get the job done. Jefferson hasn’t been acting like a guy who had discovered another portal hat to get outta town.

As far as your rules of the hat go though, I can think of one exception to the “it has to sit flat” theory. In 2-05 “The Doctor,” when Jefferson is taking Frankenstein back to his world, Jefferson tosses the hat as he spins it, the portal begins opening as it falls toward the forest floor. I think the rule of sitting flat (or in my opinion simply on a surface) has to do more with practicality and gravity than anything else. I think it could be entirely possible for the hat to open while in mid-air.
That said, I hadn’t noticed the open window (I’ll have to go back and look at that scene again) but that does seem a much simpler and more reasonable explanation, assuming the fall didn’t hurt him too bad. The height of the fall was one of the reasons why I felt that it was implied that the hat worked because otherwise he would have been hurting pretty bad (speaking from experience jumping out of similar height windows … long story, college was a fun time :P)
Your points regarding Emma are well thought out and definitely give me room for pause. But … when she made the hat, there was no magic in Storybrooke so even the original hat was difficult to get working. It’s possible that she could have made a working hat and nobody knew because nobody had enough magic (assuming we go with the Jefferson went in through the window theory).
To the point of Jefferson’s conversation with Charming, Jefferson definitely has his own motives and there is still a lot about his character to learn. What we know is that he answered Charming’s questions about the original hat but Charming never knew to ask if there were any other hats. Assuming Jefferson went in through the window, Charming’s confronting him with the remains of his old hat may have made him think of the one that Emma made and explain why Jefferson ran away from the conversation.
There may yet be a working hat in Storybrooke.
