    I agree with Phee and Timespacer, except on the contract.  Buyer should be aware, but there is also a concept that when the power of the parties bargaining are so far apart that no fair bargain is struck, that a contract is void as unconscionable.  I think selling babies qualifies.

    Then there’s the argument that Rumple owed Cinderella. Cinderella would have had her wish granted by her FGM, and she did not because Rumple killed the FGM.  Then he tried to offer her a deal to obtain it instead.  The logic of magic is tricky, but I think Cindy actually earned a wish in the fairy-magic-rationing system as they do not appear to everyone who needs help.  So Rumple stole her wish, then bargained it back to her, possibly at a much higher price (We’ll never know, depends on how sneaky fairies are in this world!).

    So anyway, I think Cinderella /Ashley had lots of reasons to break that deal with Rumple which may be why BF helped her, and they tried to imprison Rumple.   Or BF is just sneaky!

    Slurpeez, I agree.  It’s been a dark season too so a little Ariel happy ending in the middle of it would be pretty welcome.   I was thinking back to season 1 how there were these little moments of Emma helping people, bonding with MM and Henry and it was just heartwarming.    I feel like the season has been light on that emotion.

    It’s hard to see the whole list with all the pictures!  I’ll do a few of them.

    Assuming an english common law based system like in the US, and a judge with magic enough to enforce judgements and know everything we know as audience, and prove it:

    1) Cinderella Wins against Rumple.

    Agree with MedChen, though technically in the US you can make contracts for someone to pay expenses of a birth, then adopt the child, but you have the right to change your mind post birth.  Straight up selling though is not legal.  Contracts that are “unconscionable” are void (so some states something that is a criminal act, like ordering a hit, drugs or  prostitution is illegal even if both parties consent and make a deal, you couldn’t enforce the contract in a court of law).

    2) Regina vs Snow.    Regina is in the wrong for 99%, except for the candle incident.  Snow is guilty there, but it would be a lesser degree of self-defense arguably (as logically as you can assess crazy magic situations).

    Snow was only 14 when she told a secret, which a reasonable person of her age and circumstances would not realize would result in any harm, let alone the result, Daniel dying by Cora’s hand.  Cora is responsible for killing Daniel, not Snow. Regina is only  justified in not wanting to be friends with Snow for telling a secret.

    After that it was a matter of Regina usurping the throne by murdering Snow’s father, so she was not legitimately the Queen, and Snow fought a batttle to reclaim authority.  It appeared the people supported her, so Regina was rightfully deposed.

    It doesn’t matter who “starts” animosity, but in a sense of justice, it matters how each party chooses to escalate it.  If someone trips you, as Eva did Cora, it really doesn’t justify hunting them down and poisoning them years later, and then seeking to ruin the next generation’s life too.

    3)Regina V Belle:  Belle wins, Regina kidnapped her and imprisoned her presumably without cause, see above, Regina not rightful ruler anyway.  IN SB, Regina caused Belle to have false memories, so I suppose that’s similar to causing someone brain damage or a psychotic break with drugs.  Some kind of assault anyway.  Belle wins.

    4)Rumpel vs Snow.

    Rumpel took the necklace, as price for summoning him.  If Snow knew the rules of contacting Rumpel were that he could claim virtually any fee he wanted, then as long as the fee was not an unconscionable sort of deal (firstborn, murder something a crime basically), well, fair enough.  All House Rumpel Calls come with a price and it was a necklace.  That I hope we see again!  In some cases states will step in to obviously unfair bargains made under duress (which is why we have usury laws, that govern rates lenders can charge) but I’m not sure this was quite that.   Again hard to judge with the crazy situation of magic, how much should it be worth?

    5) Maurice vs Rumpel

    Belle freely made the deal and is an adult of age to bargain for herself.  Maurice has no real cause, except Belle might in the sense that her contract with Rumple might violate modern concepts of fair labor (seriously, did she have any days off, rights to care –Rumpel probably did treat her well eventually though!  Better deal than the dwarves get in the mines I think, but hey it was a feudal society!).

    6) Gepetto vs Jimminy

    Jimminy didn’t intend to kill Gepetto’s parents, but he did intend some kind of harm to his own.  Generally if you intend to harm someone but cause foreseeable harm to another you are still responsible for that harm to the unintended target (example, shooting a gun to kill one person, you hit an innocent bystander instead). Or say, making a poisoned apple turn over….so it is a bit debatable here since Jiminy’s parents suspected the danger and chose to give it to Gepetto’s family, but I think I’d still side with Gepetto. Jimminy messed with magic mojo, and brought harm to a poor little boy.

    I thought Ariel was speaking as if she were disillusioned, thinking the Godess Ursula brought her and Eric together, maybe when she saves him from drowning?  Then she is upset because she has to go back to the sea?  I think it is before the ball, before she meets Snow or Eric.

    I’m still thinking Wendy Darling is the shadow.  The real wendy died years ago and the Shadow can take on forms, but they think they killed it on NL and don’t realize it was really still there.

    Or something because where is everyone else? Regina, Rumple, Neal, Snow, and Belle?  Do they split up to deal with whatever it is?

    Yes more Ariel!  Phee, you got a dart on the board with that guess, celebrate!

    Also, how lovely is Joanna? She’s a total sweetheart.  She seems to be suggesting it is a small limited engagement role though, which disappoints me. I’m not that shocked, because Ashely/Aurora/Mulan were handled that way, plus when they cast her and it said she’d had a baby not too long ago, I thought maybe she wasn’t up for the commute.  I just really love Ariel and she is a great casting choice in the clip I saw for a “grown up” Ariel who still has the cute spunk of the character.

    What is moral and what is legal are not often the same, though we try in civilized society to get them close. In modern times we believe in the social contract and that those who rule do so with the consent of the governed–but only to a point. Depending on what country the people retain the right to select new leaders. Contrast this to the more feudal view point of haves and have nots, a class based society where your efforts and skill mean little versus the whims of those of higher station who have “birthrights”.

    People can confuse rights with privilege. There is a saying, your right to extend your fist stops where another person’s nose begins.

    I had a chilling thought.

    What if it is the other way around, what if that isn’t Wendy, but is the Shadow impersonating her, so they carry “her” back to SB, but it is the shadow all along, then we find out just before the mid-season break?

    Now now, Peter orchestrated them meeting perhaps, and wanted them to get busy, but to love?  That was their choice.  It wasn’t necessary for his plans as far as we know, though I guess it could be like Rumple was invested in Snow and Charming as a fan of what true love creates.
