A lot of us love the pirate, and wnat to see him change. Just enjoy the show. It’s just tv. Chill out.

I’m not a lawyer, but I do know you’d also have to consider how any statutes of limitations, and/or any matter of precedent might calculate into the issue. For example, did they relinquish any rights to have any say when Disney, and other entities utilized the story of Peter Pan in their own forms, for so many years, and they chose not to participate in any way which would have made them a part of creative control. By not participating, they may have set a precedent, reflected when story of Peter Pan (and it’s characters) became public domain. After all of the movies, the books, the cartoons, the books, and stage plays, a would a general principle of common law have resulted after the participants of those events completed their work and profited from it, and having done so for over 100 years? If my reasoning is correct, then this might or might not be subject to any statutes of limitations which I’m sure would have long since expired.

And there is no way that the show can lose the rights to Hook this quickly. When a company gives the rights to a show/movie, the show explain how they will use the character and the company must agree to all this to give the show their rights. They can’t just pull out and make them stop using the charcter; this is all signed.
But I highly doubt that Once Upon a Time would lose the rights to Hook because ABC (or is it Disney) would know what they are using the character for and obviously approve of it. Why would they suddenly change their mind.

I don’t know if that’s where they’re going, but it seems to me it’d put Hook in more of a Gaston type role. That can’t end well (and if that happens, I think Hook fans will be mad enough to spit nails).

sarah_tnParticipantWell the comments I read did sound a little biast toward the poster’s own preferences, so I didn’t know whether I should take what he said as fact. If Peter Pan is publc domain though, and being that ABC is owned by Disney, it looks to me like K&H are free to use Captain Hook any way they want to, any time they want to, and where they’ll ever want to. That makes me happy, because if he’s not around in season 3, even though it’s just a tv show, I know I might actually cry real tears!
sarah_tnParticipantIf the blue fairy is being killed off, if it’s a villan who is responsible for it, I have to think of Cora. Maybe even Rumpel, and that’s just because of what he said about the “dead fairy” in the episode where he used her magic wandin that cave.

I’ll give you that. I think that’s true. It’s just hard to avoid the negativity when you see so much of it, and when you feel chastised for talking about a character too much.
Here’s all I’m asking for: We all have a redeeming quality in us, and nobody is perfect in fiction, or in reality. If we all had an open mind, an open heart, and would “live and let live”, this will be a nicer place to be, if people will think before they post about how what they do might make somebody else feel.
sarah_tnParticipantIf I were Colin O’Donoghue, and I came here and saw how somebody talks about a character I’ve worked so hard to make real for so many people, I think I’d feel demoralized after reading what some of the people here have to say about Hook. It goes beyond the point of being anything constructively debatable, just hostile. More than that, the amount of attacks I see here on Captain Hook are really constant. Some of the posts make it sound like he’s everything short of being compared to satan himself. With a topic called “Eww Captain Swan Shippers”, what do you think that says to fans of Captain Hook? If it was “Eww Captain Swan”, that’d be different, but the topic attacks the shippers, not the characters. There’s too much negativity about Captain Hook, and too little posts that just talk about him. I’m not saying everyone has to like him, but if you don’t, then why attack him? I’d like to see more open minds, and positive comments here. I think that would feel like a breath of fresh air to me.
