They don’t need the rights since the book is public domain. The problem comes that they can’t use the “ruby slippers” because MGM created them. In the original story, they were silver shoes. If you buy any merchandise based off the books, which they do sell, usually in stores like Hallmark or Macy’s, they have Dorothy with the silver shoes and based off the original illustrations. Any change MGM made from the original I think they’d have to get rights for, but if they base it off the original, then all is fine.
