2) This was probably an oversight. I guess she just kept incognito to the best of her abilities. Granted she only cared about August because he was talking to Henry, though she was still alarmed when she noticed Kurt and Owen in town.
3) Most likely you answered your own question. Creating magic from magic. It’s hokey, but it’s not like we didn’t see Regina make a forgetting potion in 309’s flashback and the Dragon using magic outside Storybrooke itself. Though I imagine you have issues with those examples, too.
